Terms and conditions of sale

These terms apply to every bid, purchase and fixed-price sale made through Auto Auctioneers Auctions.

1. Registration and bidding

Only businesses approved by Auto Auctioneers (CU Auto Auctioneers Pty Ltd, ABN 36 611 739 041) may bid. Approval requires verified company details, identity documents and acceptance of these terms.

Each bid is a binding, irrevocable offer to purchase the vehicle at that amount. Bids cannot be retracted.

You are responsible for all activity on your account, including bids placed by staff you have authorised.

2. Reserve prices and sale

Most lots carry a reserve. If bidding ends below reserve the vendor may accept, decline or counter the highest bid.

A sale is concluded when the auctioneer declares the lot sold or when we issue a confirmation of sale for an online lot.

3. Buyer fees

A single buyer processing fee applies to every purchase: $195 flat for vehicles under $2,000, or $290 plus 1.1% of the purchase price, capped at $1,650, for everything above. All amounts are GST inclusive.

There is no documentation fee, no electric-vehicle admin fee, no online bidding fee and no refundable bidding deposit. The inspection report and PPSR certificate are included at no charge.

Registration transfer, stamp duty, CTP and delivery are payable by the buyer and are set by your state authority.

Storage is free for 5 business days after payment, then $40 per day.

4. Payment

Payment terms are set per vehicle and shown on the lot page before you commit: 25%, 50% or 100% of the invoice, including all fees, is payable within 48 hours of sale confirmation.

Title passes and the vehicle is released only once the payment has cleared.

We accept electronic funds transfer in AUD. The payer's name must match the registered buyer account.

Late payment may incur storage fees and, after 7 days, cancellation of the sale.

5. Delivery and collection

We deliver Australia-wide through insured carriers at $0.44 per kilometre — approximately 20% below the market average of $0.55 per kilometre — with a minimum charge of $260. The final quote is confirmed in writing before the carrier is booked.

Transit times are typically 2–5 days metropolitan, 5–10 days interstate and 10–14 days to Perth and remote areas. Transport is booked once settlement has cleared.

Collection from the yard is free and by reservation, within 5 business days of payment, by the buyer or a nominated transporter. Risk passes to the buyer on payment.

6. Condition, warranty and statutory rights

Every vehicle is physically inspected and issued with a condition grade and a PPSR certificate. Reports, photographs and odometer readings are provided in good faith as a guide only.

Where we sell as a licensed motor dealer and the vehicle qualifies under state used-car legislation, the statutory used-vehicle warranty applies: generally 3 months or 5,000 kilometres from delivery, whichever comes first, for vehicles less than 10 years old with under 160,000 kilometres (NSW, VIC and QLD class A vehicles). State conditions and exclusions apply and are stated on the invoice.

Vehicles that fall outside those limits — older, higher-kilometre, damaged, statutory write-off, non-runner and auction-only lots — are sold as-is, where-is with no statutory warranty, as permitted by state legislation.

Consumer guarantees under the Australian Consumer Law apply to vehicles supplied to consumers and cannot be excluded. Nothing in these terms limits those rights.

Where no statutory warranty applies, and to the extent permitted by law, Auto Auctioneers gives no warranty as to roadworthiness, mechanical condition, odometer accuracy or fitness for purpose. Buyers are encouraged to inspect before bidding.

7. Title and encumbrances

Title passes to the buyer only once cleared funds are received in full.

Vendors warrant clear title. Buyers are encouraged to check the Personal Property Securities Register before bidding.

8. Fixed-price sales

Fixed-price listings are sold on a first-come, first-served basis at the advertised price until the stated end date.

A submitted purchase request is an offer. The sale is binding once we confirm availability in writing.

9. Privacy

We collect company and identity information to meet our verification obligations and use it only to operate your buyer account.

Documents are stored securely and are not sold or shared for marketing purposes.

10. Governing law

These terms are governed by the laws of the State in which the vehicle is located, and the parties submit to the courts of that State.
